TIGA, the trade association representing the UK’s video games industry, has published a new, concise guide that will help studios comply with the UK’s Online Safety Act (OSA) 2023.
The OSA came into force on 26 October 2023. Its aim is to regulate illegal and harmful user generated content shared online with a particular focus on protecting children.
The OSA has important implications for companies providing online video games to the public. A games company will be regulated by the OSA if its online video game(s) and platform(s):
- allow players to interact with one another, for example via in-game text/voice chat and sharing user-generated content (UGC); and
- have a “link” with the UK – i.e. the game has a large number of UK players, the game is targeted toward UK players, or the game can be played within the UK and there is a material risk of harm to UK players.
Ofcom has been granted extensive investigatory and enforcement powers – the headline grabber being the ability to impose fines of up to £18m or 10% of a service provider’s annual worldwide turnover (whichever is higher) for non-compliance.
The Guide covers essential OSA considerations and actionable advice, encompassing:
- A clear definition of the OSA and its objectives
- How the OSA affects the video games industry, including risk assessments, moderation, reporting, T&Cs and player rights
- Circumstances when the OSA is enforceable
- Practical steps studios can take to ensure compliance and best practice
